Personally appeared before me one Henry Carrel and being duly sworn, sayeth , that on the evening of the 1st [illegible] there were two horses stolen from Captain Stocks volunteer troop, delivered at the long Bluff on the second. The Captain with 13 men this depo[illegible] being one [illegible] the Oconee river and pursued on the trail of horses and by the appearance of the sign, there were four persons, we came up with them on the bank of the Oakmulgee and discovered three Indians, [served ?] on them the fire was returned. Captain Stokes [illegible] upon them and took the ground immediately by the appearance of blood [and was ?] mortally wounded and one certainly killed in the river, one recovered [illebible] [illegible] four horses and one illegible]. [illegible , may start with Al ] rifles and one smooth bore gun, [illegible 5 words] and returned to our stations without damage except hunger and fatigue.
