Articles of Agreement made on the Seventh Day of September One Thoufand Thousand Seven Hundred and Ninety-Eight, between OLIVER WOLCOTT, Secretary of the Treafury Treasury of the United States, of the one part, and Thomas Tousey & Samuel Chipmant of Vergennes in the State of Vermont of the other part.
FIRST. The faid said Parties of the Second Part contract an engage to manufacture within the United States, and deliver to fuch such perfon person or perfons persons as fhall shall be appointed by the Secretary of the Treafury Treasury, or the Secretary of War, for the time being One Thousand ftands stands of Arms, or Mufkets Muskets with Bayonets and Ramrods complete and it for fervice service - One third of the whole number to be delivered within eight months - One other third within fourteen months, and the remaining third within eighteen months from the date of thefe these prefents presents.
SECOND. The faid said Arms fhall shall be delivered at Albany in the State of New York and fhall shall be made after the Charleville model. The Barrels fhall shall be proved and the Mufkets Muskets infpected inspected agreeably to the rules now practifed practiced and required by the United States; the Locks fhall shall be duly hardened; the Ramrods and Bayonets fhall shall be properly tempered; and the Mountings, Stocks, and every other particular fhall shall be finifhed finished in a workman-like manner, in all parts presifely precisely, or as near as poffible possible, conformably to two patterns, which have been marked, and fealed sealed by the contracting parties to this Inftrument Instrument; one of which patterns, the party of the fecond second part hereby acknowledges to have received.
THIRD. The Barrels fhall shall be proved, and the Mufkets Muskets infpeted inspected at Vergennes aforesaid by a perfon person or perfons persons to be appointed by the Secretary of the Treafury Treasury, or the Secretary of War. When due notice fhall shall have been received by the party of the firft first part, that One Hundred Barrels are ready for the teft test the proof fhall [[shall] commence, on like notice that a further number of Two Hundred Barrels are ready, the fame same fhall shall alfo also be proved; after which the United States fhall shall not be required to prove lefs less than Three Hundred and Fifty Barrels at one time. The wages of the Infpetor Inspector; the expenfe expense of powder and ball; and all other expenfes expenses attending the proving and infpecting inspecting, fhall shall be borne by the United States.
FOURTH. The Stocks of the Mufkets Muskets fhall be made of well feafoned seasoned black walnut timber, when the fame same can be procured by the Contractor otherwife otherwise, of well feafoned seasoned, tough maple timber; or the United States fhall shall caufe cause to be delivered, at Philadelphia, to the party of the fecond second part, if the fame same fhall shall be required, One Thousand well feafoned seasoned black walnut ftocks stocks in the rough, as they have been ufually usually received into the public ftores stores, at the rate of twenty-five cents each.
