The appointment of Capt. Vance and the duration of his office were wholly beyond Simmons' competency. Vance was appointed by special authority and was to be considered in office until his appointment was revoked or until his business was completed. If there were doubts on the subject of his pay Simmons should have applied to the authority that appointed him.
