Sir,
Since my letter of the 23d ulto I have received a letter from the Governor of New York inclosing an opinion of the Attorney General of that State respecting the right of issuing a Nolle Prosequi and suggesting a mode by which the adjudication of the Supreme Court may be obtained on the case.
I have accordingly written to the District Attorney to have the subject brought before the Supreme Court to be holden at Albany on the third Tuesday of October and to take such other measures for the liberation of Kee as should appear to him to be necessary.
