[Jonas Wades Contract 4-8-1800 [underline: Shoes] X 1800] Articles of Agreement made this eighth day of April, Anno Domini One thousand eight hundred, Between James McHenry Esquire Secretary for the Department of War of the United States of America in behalf of the said States of the one part and Jonas Wade of Elizabeth Town in the State of New Jersey of the other part. First. The said Jonas Wade for himself his heirs Executors and Administrators by these presents doth covenant promise and agree to and with the said James McHenry in manner following, that he the said Jonas Wade, his heirs, Executors, and Administrators shall and will furnish and deliver at the City of Philadelphia to such person as shall be appointed by the said James McHenry to receive the same Ten thousand pairs of shoes which shall pass the Inspection herein after mentioned and of the sizes following, viz; Four hundred and eighty pairs of Number twelve Five hundred and forty two pairs of Number eleven Three thousand two hundred & forty pairs of Number [strikethrough: Five] Ten Two thousand seven hundred & twenty pairs of Number nine One thousand six hundred & thirty six pairs of number eight Seven hundred and fifty nine pairs of Number Seven Five hundred and forty two pairs of Number Six, and [strikethrough: One hundred] and fifty three pairs of Number Five. That the said shoes shall be delivered to the person appointed to receive the same at the times and in the quantities following, to wit: Two thousand pairs on the tenth day of May, two thousand pairs on the tenth day of June, two thousand pairs on the tenth day of July, two thousand pairs on the tenth day of August, and two thousand pairs on the tenth day of September next ensuing, and that each of the said shoes shall be furnished with a good and sufficient Leathern Thong. That each delivery shall consist of an equal proportion or as near there to as may be of each of the several sizes herein before mentioned — and that previous to any shoes being received the same shall be examined and inspected at Philadelphia by a person to be appointed by the said Secretary of War, which Inspector shall be well skilled in the business and shall be sworn to the faithful execution of the duty, and all shoes which the said Inspector shall declare not to be of the proper or pattern size or not to be equal in goodness of materials and workmanship to the patterns, number six, number eight, number nine, number Ten, or number twelve which are sealed with the [undecipherable: leaden] seal of the War Office and [undecipherable: deposited] therein, shall be rejected and the Inspector may if he thinks proper mark all such shoes as he shall so reject with a stamp to be provided for the purpose. Secondly. The said James McHenry hereby engages on behalf of the United States to pay to the said Jonas Wade the sum of ninety seven cents for each and every pair of shoes that shall pass inspection and be received by the person authorized to receipt for [strikethrough: them] — the payment of each delivery to be made as soon as the delivery is made and the necessary Receipt produced for the same. Five hundred dollars shall be advanced to the said Jonas Wade on signing this agreement — Two hundred and fifty Dollars thereof shall be accounted for on the payment for the first delivery, and the residue thereof on the payment for the second delivery. It is hereby clearly understood by the said Parties that no allowance whatever is to be made to the said Jonas Wade for bringing the Shoes to Philadelphia or any compensation to be allowed for or account of all or any of the Shoes being rejected by the said Inspector In Witness whereof the said James McHenry Sec^t of War hath here to set his hand & affixed the Seal of the War Office, and the said Jonas Wade hath here to set his hand and seal the day & year first herein written.
