This agreement witnesseth, that the said James M'Henry, for and on behalf of the said United States of America, and the said [blank] his heirs, executors and administrators, here mutually — — Full. The said [blank] his contractors or Administrators, their [heirs, legally,] and here agreed to furnish and deliver, or cause to be furnished and delivered, the articles hereafter specified, and which shall be hereafter required of him or them until the thirtieth day of September, one thousand eight hundred, at the respective rates mentioned hereafter with viz. For every complete ration issued at Niagara, fifteen cents. For every complete ration issued at Presqu'isle, thirteen cents and eight tenths. For every complete ration issued at [undecipherable], thirteen cents and eight tenths. For every complete ration issued at Michilimackinac, nineteen cents and three-tenths. For every complete ration issued at any place or places, on the east side of the Mississippi River, below the mouth of the River Ohio, at the mouth and south of it, and at other ports or places in [undecipherable], fourteen cents. For every complete ration issued at Knoxville, Tellico Block-house, and at other posts or places in Tennessee, encamping on the Mississippi, fourteen cents. It is understood, that it shall be in the option of the General or officer commanding an army or a river, military post of all rules, not otherwise provided for by this contract, to detail where, and how often each of said stores shall be [weighed or] measured; one before the delivery, a [competent] time before its [use/issue] to commence; that in all such, where he [or all, or general orders,] is provided all [?] shall not be required; but it is required; that the Contractor leave two days [undecipherable] for every two days [undecipherable] in every work, and the ration of bread or flour, for the remainder of the work; the said [Contractor,] that in the [army of his/issue,] if one or more, one per man, shall be deducted from the price of each, or every parcel weighed, for the dead and wastage, but such parcel weighed, shall contain no greater or less quantity than a Barrel, or fifty Gallons; the commanding officer [shall] not make any allowance where it [amounts] to [?] less than one hundred rations; the compensation being required by competent. That the Supplies shall be furnished by the [said undecipherable] to the garrisons of [undecipherable], [undecipherable], [undecipherable: Niagara], [undecipherable], [undecipherable], and [undecipherable], in such [quantities], as the [troops] may require, to furnish the troops for the space of six months in advance and in the [undecipherable], and at the other posts the Contract shall [undecipherable], for the Supply of the troops, for the [undecipherable] three months in advance, in good and wholesome [provisions], one [undecipherable] [shall] [undecipherable] all [articles], or for [no less than] the [undecipherable], or for the [undecipherable]; and [undecipherable] [shall] [undecipherable] [undecipherable] [furnished] at each of the other posts [undecipherable] there by [there?] a [sufficient] quantity of [like] [undecipherable], at least three months in advance. Fourth. That no advance of money, for [undecipherable] [each] [undecipherable], [shall] [undecipherable] are [paid] the rations, shall be purchased by the said for the purpose [stipulated] in this contract. Fifth. That whenever at or often as the provisions [stipulated] to be furnished under this contract, Shall in the opinion of the commanding officer of the post, be unsound, or unfit for use, a Survey Shall be held thereon, by two disinterested persons, one to be chosen by the commanding officer of the post, and the other by the said [blank] or his agent, and in case of disagreement, a third person to be chosen by mutual consent, who shall have power to condemn such articles as are of bad quality. But if the said [blank] or his agent, shall fail, or neglect to appoint a person, to inspect the said provisions, within five days after notice being given by the commanding officer of the post, which notice shall be in writing; then, and in that case, it shall be lawful for the said commanding officer, to appoint such person, as he may think proper, to inspect the provisions, under such, with powers as aforesaid as aforesaid. Sixth. That the said [blank] or his agent shall keep an accurate account, at each post, in a fair and regular manner, of issues in the quantity of provisions, contracted to be delivered and kept up, shall have power to supply the deficiency, by purchase, at the expense of the said contractor. Seventh. Whenever any articles constituting the ration, or any part of the ration, shall not be in Store, and withheld from the troops, it is also fit; but he gives receipts therefor within six months, and [unless] he delivers the articles which shall cut at the expiration of the said two months, the contractor, or his agent, Shall not deliver the articles requested in the said first bills, within the time mentioned in said demand notice, the commanding officer of the garrison may supply the deficiency by purchase at the expense of the contractor. Eighth. That the said [blank] or his agents, Shall, at each post, or place, where Supplies Shall be required, under this contract, render a monthly abstract, to the commanding officer thereof, specifying the quantities and species of the Supplies on hand. Ninth. That all losses [occasioned] by the depredations of an enemy, or by means of the troops of the United States, Shall be made good to the said [blank] by the United States. And in case of failure, in any other respect, Shall be paid for in other property reasonably used in conducting the same, Shall be paid for in the form of a voucher, or [appraisal] value of the articles taken, or the receipt of a commissioned officer, or [at their fair value] where the same can be obtained, the [circumstances] of the [evidence?] and the amount of the articles lost by [computation?] is claimed. Tenth. That bonds given for the failure of the provisions, and for the protecting of the cattle [equally] as money Shall be furnished, whenever in the opinion of the commanding general of the army, or of any post, to whom [application?] may be made [therefor], the same can be [spared] with safety, or [undecipherable]. Shall not be answerable for any deficiency of Supplies, at any of the [said] posts or places, if it Shall appear upon [full] Sufficient proof, that Such deficiency was [occasioned] by the want of proper [routes] and guards. Eleventh. That at all [Stationary] posts, proper Store-houses Shall be provided on behalf of the public, by the reception of the provisions, and kept in good [repair?] from time to time, as they are [required] by the [proper officers?] [undecipherable]. Twelfth. That the said [blank] his executors, or administrators, shall render his accounts to the proper officer, or department, at least once in every Six months, agreeably to such forms as the [form] may be [required], to be established and made known to him. Thirteenth. That all [such] advances of money at may be made to the said [blank] towards the Supplies [stipulated?] [undecipherable] herein, [at?] the [Commander] [undecipherable], or [Inspector] in Chief may be [shipped?] at this [contract?] in [undecipherable], in lieu of procure [supplies,] in consequence of any failure on the part of the [Contractor]. Fourteenth.
