Articles of Agreement made on the fifth day of April, One thousand seven hundred and ninety nine, between Oliver Wolcott Secretary of the Treasury of the United States of the one part and Owen Evans of Providence township & County of Montgomery in the State of Pennsylvania of the other part.—
First. The said Owen Evans contracts and engages to manufacture within the United States & deliver to such person or persons as shall be appointed by the Secretary of the Treasury, or the Secretary of War, for the time being, One thousand Stands of Arms or muskets, with Bayonets & Ramrods complete and fit for service, the whole number to be delivered within twelve months from the date hereof, in parcels of not less than two hundred at one time.—
Second. The said Arms shall be delivered at Philadelphia in the State of Pennsylvania, and shall be made after the Charleville model.— The Barrels shall be proved and the muskets inspected agreeably to the rules now practised and required by the United States, the Locks shall be duly hardened; the ramrods and bayonets shall be properly tempered; and the mountings, stocks, and every other particular shall be finished in a workmanlike manner, in all parts, precisely, or as near as possible, conformably to two patterns which have been marked and sealed by the contracting parties to this Instrument, one of which patterns the party of the second part hereby acknowledges to have received.
Third. The barrels shall be proved, and the muskets inspected at Providence in the State aforesaid by a person or persons to be appointed by the Secretary of the Treasury, or the Secretary of War. When due notice shall have been received by the party of the first part that two hundred barrels are ready for the test, the proof shall commence, and on like notice that a farther number of two hundred barrels are ready, the same shall also be proved, until the whole number of barrels required shall have been proved. The wages of the Inspector, the expense of powder and ball, and all other expenses attending the proving and inspecting shall be borne by the United States.
Fourth. The Stocks of the muskets shall be made of well seasoned black walnut timber, when the same can be procured by the Contractor, otherwise, of well seasoned, tough maple timber; or the United States shall cause to be delivered at Philadelphia, to the party of the second part, if the same shall be required, one thousand well seasoned black walnut Stocks in the rough, as they have been usually received into the public Stores, at the rate of twenty five cents each.
Fifth. The party of the first part contracts for, & on behalf of the United States, to pay or allow in settlement, Thirteen Dollars & forty cents for each and every of the Stands of arms which shall be manufactured according to the pattern & delivered after proof & inspection as aforesaid.—
Sixth. Two thousand six hundred & eighty Dollars shall be advanced to the party of the second part on closing this Contract, to be repaid by him to the Treasury of the United States within twelve months from the date of these presents.—
It is also agreed, that for each delivery of two hundred muskets made & completed agreeably to pattern, the party of the first part shall cause an advance, equal in value thereto at the contract price, to be made to the said party of the second part until the number of Eight hundred muskets have been completed and delivered; and that the remainder of the one thousand muskets contracted to be delivered by the said party of the second part shall, when delivered, be in satisfaction of the advance of two thousand six hundred and eighty dollars mentioned in the beginning of this article.—
