Articles of Agreement made on the Sixteenth day of January One thousand seven hundred and ninety nine, between John Habersham Agent for the supply of the Troops of the United States in the State of Georgia of the one part and Solomon Ellis of the County of Columbia in the said State of the other part.
This Indenture Witnesseth, that the said John Habersham for and on behalf of the United States and the said Solomon Ellis for himself his heirs executors and administrators have mutually covenanted and agreed, and by these presents do mutually covenant and agree, to and with each other as follows.
First. That the said Party of the [strikethrough: first] second part shall furnish such articles as shall be required of him for the use of the Troops of the United States at any of the posts or places within the limits or boundary line of the State of Georgia, as concluded upon and established by the Congress of the United States on the seventh day of August one thousand seven hundred and ninety with the Creek Nations, or at any post or place within the distance of five miles beyond the said boundary line that may now or hereafter be established, or on their march within the limits aforesaid, for and during the term of one year to commence the Sixteenth day of January one thousand seven hundred and ninety nine and end the sixteenth day of January one thousand eight hundred according to the following regulations, namely.
The Commanding Officer of the Troops and the Officers commanding seperate parties or posts are to be responsible to the Public, that only such articles or transportation as are indispensibly necessary shall be required of the said Contractor.
The orders and receipts, in the manner hereafter stated, shall be considered as essential vouchers in the settlement of the accounts, as will be the original bills of articles purchased, or copies thereof properly certified, which shall be verified on oath, if required.
No articles must be supplied, but in consequence of Written requisitions from the commanding Officer of the Troops, or the commanding Officer of a seperate Post or party; the latter must, however, in cases where it is practicable, have the sanction of the commanding Officer of the Troops.
Receipts for all articles or transportation so furnished, to be given by the Quartermaster acting under the orders of the commanding Officer or by the commanding Officer of a seperate party or post to whom the articles or transportation may be furnished.
Secondly. On the amount of the articles & transportation furnished by the said contractor, he is to be allowed five per cent commission for transacting the business and making the necessary advances, which sums, together with the sums advanced are to be paid by the Secretary of the Treasury on the passing the accounts at the Office of the Accountant of the War Department of the United States. The said accounts to be settled every six months.
It is understood before the signing of this Agreement, that by the words "such articles as shall be required of him for the use of the Troops of the said United States in the State of Georgia" it is intended, that the party of the second part shall furnish such articles in the Quarter master and Hospital Departments as may be required of him for the use of the said United States.
In Witness whereof the said John Habersham on behalf of the said United States hath hereunto subscribed his hand and affixed the seal of his office and the said Solomon Ellis hath hereunto subscribed his hand and affixed his seal the day and year above written.
