Mr Fisher wishes me to State to you the present terms on which I in behalf of the United States rented one half of the Powder Magazine belonging to the State of Pennsylvania, both then and now under his Superintendance; my idea is that one half of the Magazine was at all times absolutely at the disposal of the Government by or through any of its Agents, but if any time more Powder or Stores of any kind were deposited in it, than would occupy the Moiety of the Building, such surplus was to be paid for, as by Law established or is customarily paid by private persons for such Storage. Another consideration claims attention if the Powder deposited by you has been received, Stowed & delivered, by the people employed by Mr Fisher, the Expences attending it ought in my opinion to be borne by the Public. My engagement with him was confined to the receiving, Safekeeping and delivering such Powder & Stores only as were under the immediate direction of the War Department— indeed at the time of renting the Magazine I had no reason to expect, that any thing of the kind would be made Subject to any other order.
In justice to Mr Fisher I have made the foregoing observations.

I will thank you to inform me what prospect there is of obtaining payment on the Account rendered you by John Harris, Public Store keeper for One hundred Common Tents with Poles amounting to 1093 ½ Dolls. The Tents were used by the health Office, but the Commonwealth of Penna is made chargeable with them by your receipt and you I conclude will make the payment.
