Smith, has held connivance with fox, and entered into some population project with him, for I have proof from a Col. Perry, that Cox [undecipherable: aported] in New Orleans, he has succeeded with the Governor to his wishes, and from another quarter, that the Governor had apologized to him, for not giving him his attentions in public, as he, the Governor, was unwilling to give umbrage to the American Officers. I observe that much discontent and disgust, prevail among the people of this Territory; some have removed into the Spanish Territory, and I understand many propose to follow — among them a Son of Old Hutchins and a Doctor White; formerly of Congress, are actually on the Wing — This defection has been excited, by the Arts of a few Mal-contents, who misrepresent and misinterpret, to the ignorant, the Acts of the Governor and the views of the Government — Three things appear to me essential to the repose and prosperity of this Territory — The presence of the Judges — the Settlement of the right of foit and jurisdiction — and the establishment of some principle, by which to ascertain and fix Individual rights to land granted within the Territory — I beg your excuse for this hasty Scrawl and am with great consideration & respect Sir Y^r most obed^t Serv^t (signed) Ja.
