Articles of Agreement
Made on the twenty ninth day of August one thousand Seven hundred and ninety eight, between James McHenry Secretary of War of the United States of America, for and on behalf of said States of the one Part, And James O'Hara of the State of Pensylvania of the other Part.
Whereas by a certain agreement between Oliver Wolcott Esquire Secretary of the Treasury, and the said James O'Hara bearing date the Thirteenth day of March One thousand Seven hundred and Ninety Seven.. It was stipulated that the Party of the Second part should deposit Six months Supplies in advance, at certain Forts therein mentioned and three months Supplies at certain other Forts, if the same should be required
NOW Therefore this Indenture witnesseth that the said James McHenry for and on behalf of the United States of America and the said James O'Hara for himself his Heirs Executors, and Administrators have Mutually Covenanted and agreed as follows —
1st. An Inventory shall as soon as possible be taken, or at least on or before the first day of November next, which Shall Comprize all but no other, than such Supplies as shall have been delivered on or before the last day of September next And such as remained unexpended at the different Forts on the said day in pursuance of positive Stipulations in the aforesaid Agreement, or of requisitions from the Commanding of the Army.
2nd. That the Inventory shall be taken in the Presence of the Commanding Officer of the Post, and the Party of the Second Part, or his Agent, and Duplicate Receipts given therefor by the Said Party of the Second Part or his Agent to the Commissary or or other responsible Person expressing the quantity and quality of each article.
3rd. That the party of the Second part shall Account to the United States for all the Supplies which shall be received for, as in the Preceding Article he being allowed however a deduction of twelve and a half per Cent as a full allowance for Wastage Leakage and Dammage, of whatever nature excepting only such losses as may be [undecipherable] occasioned, by Fire, Water, an Enemy, or by the Troops of the United States.
4th. That the party of the Second part Shall issue all the Supplies as aforesaid to the Troops at the Several Forts in Rations to consist as follows, viz.
Eighteen Ounces of Bread, or Flour One Pound and a quarter of Beef or three quarters of a Pound of Pork, a Gill of Rum, Brandy, or whiskey, And at the rate of two quarts of Salt, four quarts of Vinegar four pounds of Soap, and One Pound and a half of Candles to every hundred Rations.
5th. That the said party of the first part shall Pay or cause to be paid, to the Said Party of the Second Part, One Cent for every Ration which he Shall issue as before recited, as a full Compensation for his trouble and expence in Issuing the Same—
