[1798, May 19] 537 Whereas it is stated that Samuel Barnets Ensign in the third Regiment of foot hath been arrested by Edward Miller, Captain in the third Regiment of Infantry on the following charges: First for defrauding the United States in enlisting Soldiers, and discharging the same, and receiving premiums from the said Soldiers, and employing them as laborers for a certain time for the enrichment of the said Samuel Barnets. Second for bartering with Soldiers for [undecipherable] purchasing their provisions, and defrauding them of their bounties. Third for behaving in a manner unbecoming an Officer and a Gentleman. It is therefore thought [undecipherable] necessary that a General Court Martial should [be assembled] by the Officers [undecipherable] authorized [undecipherable] and determine upon the matters and [undecipherable] above charges, at such [time] as may be in proper time specified, and [proceed] to the Court according to the usual forms in such cases prescribed by the Rules and Articles for the better Government of the Troops raised or to be raised and kept in pay by and at the expense of the United States of America, and such sentence pass in the premises, as by the same shall be authorized. The President of the United States therefore appoints Major Thomas H. Cushing, President, Captains Donald Grant, Mitchell and Morris, Lieutenants John M^cClallen, Nehemiah Freeman, Henry Muhlenberg, William [undecipherable], Horatio Dayton, John Saunders, and Philip [undecipherable], Ensigns William R. [undecipherable] and George W. Stahl, Members of a General Court Martial to try and adjudge upon the aforesaid Charges and such others as may be properly specified, the aforesaid Samuel Barnets Ensign in the third Regiment of Infantry and such Sentence pass upon the same as may be authorized by the aforesaid Rules and Articles of War, and you and the said Officers are to meet at the City of Philadelphia on the twenty eighth day of May instant for the purpose of constituting the said Court, and proceeding to the said Trial. The Court are hereby directed to issue Summons for such persons as shall be judged necessary, or required by the Party or Parties so to be, to give evidence touching all matters before the Court, and pertinent to the aforesaid Trial. And the said Court is hereby required strictly to examine into the matters aforementioned, and record the Evidence and circumstances touching the same all which, together with the Sentence of the Court you will transmit to the Secretary for the department of War, to be by him laid before the President: and for so doing, this shall be as well to you, as to the said Officers, and all others concerned, a sufficient Warrant.
