[Contract for Supplying Clothing] Articles of Agreement between Oliver Wolcott jun^r Secretary of the Treasury of the United States of America and Thomas Billington of the City of Philadelphia. First That the said Thomas Billington shall furnish and deliver to the order of the Secretary, for the department of War the several articles of Clothing specified in the annexed Schedule at the respective prices therein mentioned, which Schedule to prevent misunderstanding, shall be countersigned by the parties to this Agreement. Secondly That the said Clothing shall be delivered at the City of Philadelphia in the manner following Towit: One fourth Part on or before the fifteenth day of February next; One other fourth part on or before the fifteenth day of April next; and the remaining half on or before the fifteenth day of June next; A Vest to be deemed to consists of the following Articles Viz^t: One Coat, one Vest, two pair Woollen overalls, [undecipherable] and two pair of Socks. Thirdly That the said Clothing respectively shall be agreeable to such patterns, as have been directed by the Secretary, for the department of War and fully equal as to quality to the samples which have been presented at the Office of the said Secretary, and shall be delivered to the person or persons or him duly appointed to receive and receipt for the same. Fourthly That previously to the said Clothing being received for and on the part of the United States the dimensions and Workmanship of the respective Articles and the Quality of the materials shall be inspected by two reputable and well informed persons who shall be on Oath, one of which persons is to be chosen by the Secretary of the Treasury and the other by the said Thomas Billington and in case of disagreement of these Persons, shall be chosen by mutual consent, who is also to be under Oath. Fifthly That the said Secretary of the Treasury on behalf of the United States shall pay or cause to be paid to the said Thomas Billington, for the Clothing to be furnished under this Contract, in proportion and at the different periods of delivery mentioned in the second Article, he shall make such advances to the said Thomas Billington as to him the said Secretary shall appear reasonable. In witness whereof the said Secretary of the Treasury on behalf of the said United States of America hath hereunto subscribed his hand & affixed the Seal of the Treasury. And the said Thomas Billington hath hereunto subscribed his hand and set his Seal at Philadelphia in the State of Pennsylvania the thirteenth day of November in the year of our Lord One thousand seven hundred and Ninety Seven and of the Independence of the United States the twenty Second.
