[Copy] Articles of Agreement made on the 30^th day of March Anno Domini 1797 Between Oliver Wolcott Junior Secretary of the Treasury of the United States of America of the one part and James O'Hara of Pittsburg of the State of Pennsylvania of the other part. This Indenture Witnesseth that the said Oliver Wolcott Junior for and in behalf of the Said United States of America and the Said James O'Hara for himself his Heirs Executors and Administrators have mutually covenanted and agreed to and with each other as follows viz 1^st That the party of the Second part his Executors and Administrators Shall deposit supply and Issue all the rations herein Specified and which Shall be required of him for the Service of the United States from the 1^st day of June 1797 to the 30^th day of September 1798 at the respective posts and places at the following prices For every complete ration Issued at Oswego 18 6/9 Cents Niagara 18 [6]/9 " Presque Isle 18 6/9 " Sandusky 23 3/9 Michilimackinac 25 5/9 Fort Franklin — 12 3/9 Pittsburg — 12 6/9 Cincinnati 13 [undecipherable] Tioga Town &c Fernius Store } 13 5/9 Cents Fort Wayne 23 3/9 — Fort Defiance 18 6/9 For Every ration complete Issued from Defiance To mouth of Miami 18 6/9 Cents For Every complete ration Issued at Steuben 13 5/9 Fort Massac 15[cents] On the Mississippi below the South Boundary of Kentucky — } 17 Fort Knox 17 Ouiattanon 17 2/[undecipherable] at any post or place within the State of Tenisee the Mississippi Excepted,) and not already provided for by Existing Contracts or arrangements for the Years 1797 — 13 5/9 It is agreed however that the Contractor Shall furnish and Issue all the the Supplies which may be Required for the Troops of the United States in the State of or on the Frontiers of Tenisee from the 1^st of January 1798 to the Expiration of this Contract Should any rations be required at any place or within any other districts not Specified in this Contract the price of the Same Shall be hereafter agreed on Between the Publick and the Contracted But it is to be Understood that it is in the Option of the Publick to require the Delivery of the rations at any of the Enumerated posts or places tho' designed to be Consumed at Other places or posts Paying the Stipulated prices at the places of delivery Provided that if the Contracted Shall have Been required to Deposit provisions at any place or post and Shall afterwards be required to remove them to be delivered at Another place or post at Which the price of the ration is lower than at the first mentioned place or post the price to be Allowed for Such provisions so removed Shall be at that which is Stipulated to be paid at the Said first mentioned place or post together with the Expenses of Transportation to Such Other place or post — II That the rations be furnished and Delivered by Vertue of this Contract Shall Consist of the following Articles, viz. one pound of Bread or Flour One pound [undecipherable] of Beef or Twelve ounces pork or Bacon half a Gill of rum Brandy or Whiskey one quart Salt Two quarts Vinegar Two pounds Soap } per hundred rations — 14 5/9[s] 19 [undecipherable] pound Candles and it Shall be in the Option of the party of the Second part to Issue beef pork or Bacon and in all Cases where Salted provisions is Issued the Article Salt Shall not be required That in the Delivery of Bread Flour or meal one per Cent Shall be deducted from the Gross Weight of every Barrel Weighed for drawback and Wastage, But each parcel Weighed Shall Include no Greater number of rations than are Sufficient for a regiment nor Shall there be Any Allowance When it Comprises less than one hundred rations — In lieu of this Allowance the Commanding Officer of Corps [and] Detachments may require Deliveries by Companies; it is also Understood that the Commanding Officer may at any Cents Liquor " 5 Cents Meat " 5 " Small Articles " 6/9 " III That the Supplys Shall be furnished by the party of the Second part at the posts of Oswego Niagara Presque Isle Detroit Michilimackinac Fort Defiance Fort Wayne and Fort Miamis in Such quantities as that there Shall always be Sufficient for the Consumption of the Troops for the Space of Six Months in advance in Good and Wholesome [provisions] to consist of Salted Beef or pork or Both and a Corresponding quantity of flour and Other Articles forming the ration and there Shall be if required at each of the Other posts mentioned and provided for in Contract Such quantities of like provisions as [are] Sufficient for the Consumption of the Troops the Space of at Least three Months in Advance That no Whiskey but Such as has paid the Excise Shall be purchased by the Said James O'Hara for the purposes Stipulated in this Contract That Whenever or as Often as the provisions Stipulated to be furnished under this Contract Shall in the Opinion of the Commanding Officer of the post be Unsound or Unfit for use a Survey Shall be held therein by two Disinterested persons one to be Chosen by the Commanding Officer of the post and the Other by the Said James O'Hara or [his] Agent and in case of disagreement a third person to be chosen by mutual Consent who Shall have power to Examine each part of the provision as to [him] may appear unfit for use But if the Said James O'Hara or his Agent Shall fail or Neglect to appoint a person to Inspect the [said] provisions Within five days after notice being given by the Commanding Officer of the post Which Shall be in Writing then and in that case it Shall be lawfull for the Said Commanding Officer to appoint Such persons as he may think proper to Inspect the provisions Under Oaths with power to condemn as aforesaid VI The Brigadier General or person appointed [by him] at each post (the posts in Tenisee excepted) in Case of absolute failure or deficiency in the quantity of provisions Contracted for to be delivered or kept up Shall have power to Supply the deficiency by purchase at the risque and on account of the Said James O'Hara VII That the Said James O'Hara or his Agents Shall give due bills to the Officers and Soldiers for such parts of the rations as may be Withheld from them to be paid every two months either by the Articles Withheld or at the Contract price by the S[ai]d James O'Hara the One or the Other to be [paid] in the Option of the Said Contractor or his Agent — VIII It is to be Understood that the Said James O[']Hara is to receive Instructions relative to Supplies for Any Troops Stationed in the State of Tenisee or at Any posts Southward thereof Solely from the Commanding Officer in that district or the Agent for the Department of War IX That all losses sustained by the depredations of an Enemy or by means of the Troops of the United States With regard to the Articles Comprising the ration as well as to the Other property necessarily Used in Transportation the Same [shall be paid] at the Contract price of the Component parts and at an Appraised Value of other Articles on the deposition of one or more Creditable Characters and the Certificate of a Commissioned Officer Where the Same can be [used in] Ascertaining the Circumstances of the loss And Amount of the Articles for which Compensation [is] Claimed That Escorts and Guards for the Safety of provisions and for the protection of the Cattle against an Enemy Shall be furnished whenever in the Opinion of the Commanding Officer of the Army or of any post to Whom Application may be made the Same can be done Without prejudice to the Service and that the party of the Second part Shall not be Accountable for any Deficiency of Supply of rations at Any of the Said posts or places if it Shall Appear upon Satisfactory proof that Such Deficiency was Occasioned by the Want of proper Escorts and Guards That at all Stationary posts proper Store houses Shall be provided on behalf of the [undecipherable] Publick for the reception and Safe Keeping of the [pro]visions deposited from Time to time at Such Respectively XII That at all Such [undecipherable] of the Said posts or [places] Where the Issues Shall not Exceed fifty rations per day it Shall not be Incumberant on the party of the Second part to Employ a Commissary for Issuing of rations but rations may be Delivered in Bulk the Vouchers for Which Shall be a receipt Certificate from the Officer Commanding at such post who Shall provide for and direct the Issues thereof Regard being had that the Deliveries be proportioned to the Number of Troops at Such [fort] and the Instructions Which Shall have been Given to the Contractor by the Brigadier General or Commanding Officer of the [Army] — it is also Agreed that at the last mentioned posts the Contractor Shall When the Season will permit furnish [the] Troops with a portion of fresh Meat — XIII That the party of the Second part his Executors and Administrators Shall render his accounts to the proper Officers of the Treasury for Settlement at least once in Every Six [months] Agreeably to the form hereunto Annexed or by Such Other as the Comptroller of the [Treas]ury may hereafter be Established and made [known] XIV That all Such Advances of money as may be made to the Said James O'Hara towards Sup[plies] to be furnished pursuant to this Contract and all Such Sums of money as the Commander in Chief [may] be Obliged to disburse in Order to procure Supplies [upon] any failure on the part of the Said James O'Hara in Complying with the Stipulations herein Contained Shall be duly Accounted for by him by way of Set off against the Amount of the Supplies and the Overplus if any paid the United States Immediately after the Expiration of the term of this Contract together with an Interest of the rate of Six Per Cent per Annum from the time of Such Expiration, untill the Same Shall be actually repaid and that if any Balance [shall on any Settlement of the Accounts of the] Said James O'Hara his Executors and Administrators be found to be due to him or them for or by reason of the rations Which Shall be Supply[ed] pursuant to this Agreement the Same Shall Immediately be paid and no Unnecessary or Unreasonable Delay on the part of the Officers of the United States Shall be Given to the Settlement of the Accounts of the Said party of the Second part his Executors and Administrators.
