'Tis agreed however that this Contractor [undecipherable]

2 That the Rations to be furnished and delivered by
Virtue of this Contract shall consist of the following

One pound of Beef or Twelve Ounces of Pork or Bacon
Half a Gill of New Rum Brandy or Whiskey —
One Quart of Salt
Two Quarts of Vinegar}
Two pounds of Soap } per Hundred Rations —
One pound of Candles }
And it shall be in the Option of the party of the second
part to issue Beef Pork or Bacon, and in all cases where
salted Provision is issued, the article of Salt shall not
be required — That on the Delivery of Bread Flour or
Meat the per Cent shall be deducted from the gross

but each parcel Weighed shall include no greater
number of Rations than are sufficient [undecipherable] [undecipherable]
nor shall there be any allowance where it contains

6th That the Inspector General or person appointed by

note absolute failure or deficiency in the Quantity
of provisions Contractor to be delivered and kept [undecipherable]
shall have power to supply the deficiency by purchase
at the nearest place on account of the said James O'Hara
7 — That the said James O'Hara or his Agent shall give
[undecipherable] Bills to the Rivers and [undecipherable] [undecipherable] [undecipherable] [undecipherable] for the
Rations as may be withheld from them to be paid
every two Months either by the Tickets withheld or at
the Contract price by the said James O'Hara the same
or the like to be at the Option of the said Contractor or
his Agent. —
8 — It is understood that the said James O'Hara is
to receive Instructions relating to Supplies for every
Troops stationed in the State or Territories of Tennessee
or at any posts to the Southward and through [undecipherable] solely from
the Commanding Officer in that District or the Agent
for the Department of War.
9 — That all losses sustained by the Depredations of
an Enemy or by means of the Troops of the United States
with regard to the Articles composing the Ration as
well as to other property necessary in Transporting
the same shall be paid for at the Contract price of the

Orders of the articles on the Disposition of losses incurred to the
Character and the Certificate of a Commissioned Officer (when

is claimed —
10 — That every Voucher for the [undecipherable] [undecipherable] [undecipherable] Transmissions

shall be furnished whenever the Opinion of three
Commissioning Officers of the times or of any post to

or the [undecipherable] [undecipherable] is to be [undecipherable] [undecipherable] [undecipherable] and that the party of
the second part shall not be answerable for any Deficiency

11 — That at all stationary posts for [undecipherable] Store Houses
shall be provided on Behalf of the public for the
reception and safekeeping of the provisions deposited
from time to time at each post respectively —
12 — That at each of the said posts or places where
the Stores shall not exceed fifty Rations per Diem it
shall not be incumbent on the party of the second part
to employ a Commissary for the issuing of Rations, but
Rations may be delivered in Bulk. The Vouchers for
which shall be a Receipt or Certificate from the Officer
Commanding at any such post who shall promise, for
and declare that [undecipherable] [undecipherable] [undecipherable] [undecipherable] [undecipherable] [undecipherable] had that
the Deliveries be proportioned to the number of Troops at such
post; and the Instructions which shall have been given to
the Contractor by the Brigadier Generals or Commanding
Officer of the army. It is also agreed that at the last
mentioned posts the Contractor shall where the occasion will
permit furnish the Troops with a portion of fresh Meat.
13th That the party of the second part his Executors and
Administrators shall render his accounts to the proper
Officer of the Treasury for adjustment at least once in
every six Months agreeable to the forms by [undecipherable] [undecipherable]
or by such other as the Comptroller of the Treasury may
hereafter be established and made known to him —
16th That at such advances of Money as may be made
to the said James O'Hara towards the Supplies to be
furnished pursuant to this Contract, and at such times
of Money as the Commanding in chief may be obliged to
disburse in order to purchase Supplies in consequence
of any failures on the part of the said James O'Hara
in complying with the Stipulations herein contained
shall be duly accounted for by him, by way of [undecipherable] [undecipherable]
against the amount of such Supplies, and the Surplus
if any to be paid to the United States immediately after the
Expiration of the time of this Contract, together with
interest at the rate of [undecipherable] per Centum per Annum from the
time of such Expiration until the same shall be actually
repaid, and that if any Balance shall on any Settlement
of the Accounts of the said James O'Hara, his Executors
and Administrators be found the [undecipherable] [undecipherable] [undecipherable] for

to this agreement the same shall immediately be paid;

part his Executors and Administrators. —
