Col^t Rochefontaine to drive the Team, for which he allows him a part of the earnings for his labour — that the materials as well as the making the Waggon was paid for at the expence of the United States and from other information no doubt remains with me but that the Horses are also Public Property — Mr Fleming also informs me that although the Receipt is signed by M^r Connice — he pays the nit amount after making a deduction for the drivers to Col^t Rochefontaine — Thus Sir it appears that Col^t Rochefontaine is receiving Pay for the Hire of a waggon and Horses employed in the Public Service and which is Public Property — I shall accordingly deduct all charges of this nature from the Accounts of M^r Fleming, as illegal in two Points of view — first it being contrary to Law, agreeably to the Resolve of Congress of the 15^th July 1780 for an Officer to be concerned in any Team Boat &c, while in the service of the United States — & Secondly — because the Property hired appears to be Public Property — I am aware Sir of the delicacy of my situation in bringing forward a charge of so serious a nature — But I should conceive myself wanting in my duty as a Public Officer did I not on any appearance of fraud to the Public make it known that it might be guarded against in future — I have therefore conceived it necessary to inform you that you may direct the necessary [strikethrough: step] steps to be taken that the Officer may be brought to account — M^r Fleming who is now in Philadelphia
