To his Claims for the 1^st Charge, it may be observed that he should have obtained payment from the Com^t of purchases on a certificate from him expressive of his services and the Amount due, which should have been presented to the Com^t for allowance; it is now too late, all Claims of that kind having been long barred by the Statute of Limitation. To his 2^d Charge — It appears that he was appointed a Muster Master on the 13^th Jan^y 1778 and was taken prisoner on the 29^th Dec^r following — That by the Act of Congress the 12^th Jan^y 1780 the Muster Masters were discharged, and were to be allowed a sum equal to one years pay. That in Feb^y 1780 he rendered an Account to Joseph Clay Esq^r Dep^t Pay Master General in South Carolina for his pay & Subsistance from the 3^d Jan^y 1778 to 3^d Feb^y 1780 amounting to Two thousand four hundred, eighty four Dollars & Forty five Cents, which sum has been passed to the Credit of said Clays Account on the 6^th June 1780 for payment made by him to W^m. Matthues, as Dept Muster Master and [underline: late] a prisoner — Thence it would appear that he could have no other claims against the United States, unless it should be for the Value of his years pay allowed by the Act of the 12^th Jan^y 1780, to this the following objection occurs, that subsequent to the settlement with M^r Clay, and after he was discharged, he has received several sums & supplies of Specie Values, that the years pay allowed by the Act was only nominal Money & would have been reduced by the State of Depreciation under date of Jan^y 1780 and would have amounted to but a small sum; not equal to the Specie he had received; of course he would have been in Debt to the United States.
