War Office. September 23, 1796. Sir, I have received your letter of the 14^th of September inst. The murder of an Indian by another Indian committed within the State of New York is in my apprehension a case cognizable by the laws of that State. I have written therefore to the Governor to obtain a Nolle Prosequi; but I cannot say that it will be obtained, or whether the Governor has power to grant it. From this interforence you will perceive that I can have no objection to his being set at Liberty. Enclosed is a duplicate of my letter of the 15 Sept^r. inst. which I hope will prove satisfactory.
