War Department 7th December 1798
Sir,
An Act of Congress, passed the 8th of May last, authorises, the proper accounting officers, to settle the Accounts of the militia, who served on an expedition, commanded by Major James Ore, against the lower Cherokee Indians, in the year 1794; and that the same be paid out of any monies in the Treasury, not otherwise appropriated.
As the returns, and rolls, necessary to the settlement of these accounts, are reported not to be here, it will be proper, that you should proceed, with as little delay as possible, in adjusting the claims for the service contemplated by the law. Taking your instructions, as to the mode of the settlement from the Accountant of the Department of War. You will draw upon me, for the amount found due.
I am Sir
your obedient servant
James McHenry
Col Darice Henly.
