Acct War Dep^t Enclosing an opinion of the Attorney General Lee on the subject of Gen^l Wayne's compensation as Sol^r Commissioner to treat with the Indians &c Department of War Accountants Office June 1^st 1796 Sir, Enclosed I have the honor to transmit you a Copy of the Decision of the Attorney General on the Subject of your Claim as Commissioner for treating with the Indians North West of the Ohio, together with an Extract of the Act of Congress of 2^d March 1793 refered to by him. [Enclosure docket:] Attorney Generals opinion on the Subject of the Claim of Gen^l Wayne as Com^r for treating with the Western Indians and Cap^t Henry De Butts as Secretary 30^th May 1796 The Attorney General is of opinion that General Wayne is entitled to receive as Commissioner for holding a Treaty with the Indians North west of the Ohio the sum of eight Dollars for each day while in actual Service in that Capacity, besides his necessary expences in pursuance of the act of 2 March 1793 — But the terms, "while in actual Service" are understood when applied to this civil appointment not to mean the whole period from the date of his Commission untill the treaty of Peace was made, but those days which were employed in pacific negotiations and in each of which some act was done by him properly pertaining to his functions as Commissioner. These should be ascertained as accurately as in his power. In as much as General Wayne was maintained by the United States as Commander in Chief of their Army during the same space of time that he was employed as Commissioner, any additional necessary expences occasioned by his civil office, and they only ought to be allowed to him. His Secretary is also to be allowed a reasonable compensation for his Services as such, although as Aid de camp to General Wayne he is entitled to his Military pay Rations [undecipherable] &c. Those Gentlemen having acted in Military & civil Departments at the same time, are entitled to compensation in each. Extract of an Act making an appropriation to defray the expence of a Treaty with the Indians North West of the Ohio. Sect 2. And be it further enacted-, That each of the Commissioners who may be appointed for managing such [undecipherable] an allowance exclusive of his necessary expences, of eight Dollars perday during his actual service, to be paid out of the monies so appropriated." 2^d March 1793 —
