War Office A treaty between the U.S & the Regency of Algiers being completed [strikethrough: in] operation and effect to the 9 Section of the "act to provide a naval armament," which section enacts "that if a peace shall take place between the U.S. & the Regency of Algiers [strikethrough: no] [strikethrough: further] proceedings be had under this act" As this event produces a virtual repeal [strikethrough: of] the act it becomes from henceforward illegal to enact by [strikethrough: any] orders or [strikethrough: measures] any new expenditures of money not [strikethrough: spent] [strikethrough: to an] required for the fulfilment of [strikethrough: preexisting] contracts, [strikethrough: made] entered into before this event. It [strikethrough: is] also [strikethrough: appears to be] within the meaning of the proviso that all orders [strikethrough: for] [strikethrough: respecting] the building of the Frigates [strikethrough: &] [strikethrough: procuring] materials for them, or preparing materials [strikethrough: already] [strikethrough: delivered] [strikethrough: procured], which can be suspended without [strikethrough: infringing] [strikethrough: upon] any actual contract or engagement should be forthwith suspended. under this view of the act it is important [strikethrough: to] [strikethrough: know] the intention of Congress on this subject as soon as possible. I [strikethrough: would] submit [strikethrough: therefore] [strikethrough: whether] some communication to Congress may not be [strikethrough: proper] [strikethrough: to] [strikethrough: suggest] it that would [strikethrough: call] [strikethrough: their] attention to it bring it [strikethrough: out] before them and hasten a decision.
