[Ensign Charles Martin: Carlisle] D. of War Accountants Office September 5^th 1795 Sir I received your letter of the 31^st Ulto inclosing a Receipt, Pay, and Muster Rolls, which shall be examined and the amount of the first be passed to your credit and the latter shall be transmitted by the first Opportunity — The reason of Law and Heavy being omitted on the last Payroll is they were returned on the Muster Rolls unfit for Military Service. I therefore concluded that they were not intitled to pay — If men are unfit for service it should be represented to The Secretary of War that they may be discharged — It is a general Rule in this Office that when a Soldier is confined in prison — or unfit for service he receives no Pay for the time as it is understood that he is not enabled to perform his duty as a Soldier — and therefore should not receive Pay. It is thought to be sufficient expence, that the United States have have to support him during that time. — I am Sir &c — William Simmons —
