[Mja Isaac Craig] N^o 467 Articles of Agreement made the tenth day of October One thousand seven hundred and Ninety four. Between Tench Coxe Commissioner of the revenue in the department of the Treasury of the United States, of the one part, and Alexander Scott and Matthew Ernest of the other part This Indenture Witnesseth that the said Tench Coxe, for and inbehalf of the United States of America and the said Alexander Scott and Matthew Ernest for themselves their heirs executors and administrators, have mutually covenanted and agreed. And by these presents do mutually covenant and agree to and with each other as follows, First, that the parties of the second part their executors and Administrators, shall supply and furnish as many Rations, to consist of the articles herein after specified as shall be required of for the service of the United States, for and during the year one thousand seven hundred & Ninety four at the places & times herein after declared, that is to say. At the post of Fort Washington and Town or borough of Pittsburg at eight cents, one third of a cent per ration, Secondly, The Ration shall consist of the following articles, Viz One pound of bread or flour One pound of beef, or three quarters of a pound of Pork or Bacon, the said pork & beef to be salted and packed in barrels, if required so to be on the part of the United States One quart of Salt . . . Two quarts of Vinegar } [hundred Rations] Two pounds of Soap One pound of Candles The flour or bread and Vinegar to be also in barrels, and the Soap & Candles to be in boxes of fifty weight, if required on the part of the United States. And it shall be in the option of the part of the second part to furnish either beef pork or Bacon (so far as regards meat) and bread or flour, and in all cases wherein salted provisions are furnished, the article of one quart of Salt per 100 rations, shall not be required likewise. That in the deliveries of bread flour & meat One per cent shall be deducted from the gross weight of every parcel weighed for draft and wastage, Thirdly, That Rations if required shall be furnished by the party of the second part in such quantities, as that there shall be sufficient for the consumption of the Troops for the Space of at least three months in advance in good and wholesome provisions at each or either of the said Posts, Provided Instructions for the necessary preparations shall be given in season for procuring and packing provisions Fourthly, That all losses sustained by the depredations of the enemy, or by means of the troops of the United States, with regard to the articles composing the rations, as well as to other property necessarily used in transporting the same, shall be paid for at the contract price for rations, on the component parts, and at an appraised value of other articles, on the depositions of two or more creditable persons, and the certificate of commissioned officers, where the same can be obtained, ascertaining the circumstances of the loss and the amount of the articles for which compensation is claimed. Fifthly, That escorts & guards for the safety of the provisions and for the protection of the cattle against the enemy shall be furnished wherever in the opinion of the Commanding officer of the Army, or of any post to whom application may be made, the same can be done without prejudice to the Service Sixthly, That the posts above mentioned, proper store houses shall be provided by the United States for the reception and safe keeping of the provisions deposited from time to time at those posts respectively. Seventhly, that the parties of the second part, their executors, and administrators, shall render their accounts to the proper officer of the Treasury for settlement, at least once in every six months, agreeably to such form as shall be prescribed. Eighthly, That all such advances of money as may be made to the said parties of the second part, towards the supplies to be furnished pursuant to this Contract, shall be duly accounted for by them, by way of set off against the amount of such supplies, and the surplus if any, shall be repaid to the United States immediately after the expiration of the term of this Contract, together with an Interest at the rate of five per Centum per annum, from the time of such expiration, until the same shall be actually repaid. And that if any balance shall on any settlement of the accounts of the said Alexander Scott and Matthew Ernest, their executors and administrators, be found due to them, for or by reason of the rations which shall be supplied pursuant to this Contract, The same shall immediately be paid. And that no unnecessary or unreasonable delay on the part of the Officers of the United States, shall be given to the settlements of the accounts of the said parties of the second part, their executors or administrators. It is further agreed by the parties to this Contract to which writing is annexed, that in all cases wherein the United States shall on due Notice, require the flour to be delivered in barrels, the difference between the actual cost of one barrel and two half barrels shall be allowed and paid to the said Alexander Scott and Matthew Ernest, provided the same shall not exceed the sum of one shilling, money of Pennsylvania, between each barrel and two half barrels. That the Soap and Candles shall be in boxes, each weighing in the gross, exclusively of the box and its contents, not more than ninety pounds. That any part of the Vinegar which shall on due notice required by the United States, shall be in kegs of not more than ten gallons each, and the sum of three shillings shall be paid and allowed to the said Contractors for every three shillings the difference between the cost of one barrel and three kegs. That the barrels which shall be bona fide, necessarily and actually used in packing any part of the salted provisions, then one third of the [undecipherable] at the advanced [undecipherable] may be supplied and procured by the United States, and a charge may and shall be made thereon against the Contractors at the rate of five shillings [undecipherable] per barrel. That the weight of the meat separable in the hides and tallow shall be ascertained at Fort Washington or Pittsburg in case of provisions required for the use of the out posts, army or detachments, and that the whole amount of the same, including the Hides and tallow shall be charged to the United States by the Contractors, and that such part of the said Hides and Tallow as shall be delivered at either of the said places of delivery, Fort Washington ington or Pittsburg, in merchantable order and condition, shall be credited to the United States, and recharged to the said Contractors; also that the quantity of one bushel of salt for every 200 lbs of meat [undecipherable] in Rations shall be furnished by the said Contractors for any quantity of the meat which shall be required to be salted, actually wanted in that form, for use at places other than Fort Washington and Pittsburg, not exceeding one third of the whole meat to be issued under this Contract.
