Pattons claim for a pension find that his case has been examined and transmitted by the District Judge of Pennsylvania &c &c & remains undetermined before Congress & a memorial presented by him also — The general question respecting the title of Officers to a pension, on returning his Commutation, appears to have been decided according to the opinion of the Attorney General, in the Act of my last opinion intitled 'an Act concerning Invalids'; but the removal of this objection does not in my opinion authorise the placing D. M. Patton on the pension List immediately; the previous sanction of Congress being necessary, and not having been obtained in the present case.
