Sir, Permit me to request your attention to the enclosed copies of letters from Col^o Hamtramck & Capt Max: Bines. — Col^o Hamtramck is most certainly an attentive & experienced Officer; a sober man & an excellent disciplinarian. — Capt Bines is also a sober and good Officer, & who most certainly has a claim to rank from the time he mentions. — probably you will find that Capt Carbery had actually resigned some time before the date of your letter announcing that resignation. — therefore if he has fraudulently drawn pay since that resignation he ought to be compelled to refund. — for it is a maxim or axiom in Law, "that no person shall be permitted to take advantage of his own wrong". — Lieut Col^o Commandant John Clark of the 4^th Sublegion has resigned on the 8^th instant which resignation I have accepted, as I did not wish to disgrace him. — he is an honest, good hearted man; but ardent spirits has completely obtained the ascendancy over reason and every resolution he has from time to time made to resist it. — his health is much impaired & he is greatly debilitated both in body & mind; I have therefore directed that he shall receive pay and rations up to the 1. July, to which period it will necessarily take him to settle his accounts & to go to Fort Washington. — That Sublegion stands much in need of a good police Officer at its head.
