The Court having convened pursuant to the above order proceeded to the trial of Mr. Jo Thrush Apothecary & Store-Keeper — who appeared before them charged with a contempt of the Commanding General's orders — to which charge he plead Not Guilty.
Caleb Crum Esqr being sworn
saith that on or about the 10th of June he received an Order from Brigr Genl Hutchinson to Mr Thrush, to have a Chest, for the Hospital, adding the public money contracted, agreeable to the direction of the Defedant he Inspected the Cotton the size of the latter, and agreed with Mr Thrush, to have it made in a fortnight. Enso the 9th July, Mrs Forks informed the Defedant it was not done, the Chest it appeared compleat in all parts except a Lock which the Defedant furnished accordingly they adjusted the Chest to make as aforesaid suitable for the use and for the greater security of the Chest the refused of faith
it was not comprehended in the Order, which the Defedant had formerly given them, that he (the Defedant) insisted it was included — Mr Thrush hesitated in his refusal of making out a new Order from the Gent, after which the Deft ment complained to the Genl and exposed that should any accident happen either by halting, pillage of the Enemy, or other cause, he should claim his recompensation from any blame, from the [strikethrough: haveing] endeavoring to have the public money property found — the Chest still remains unfinished — He further saith he made application to one Davis in Natchez, to make a Lock, and asked could he do it? he offered his hand if he had liberty, or could have other work; the Deft then spoke to Mr Thrush to not Davis about it, he objected to it altogether, offering it would take a week to compleat, and the necessary for that business —

saith, some time in June, he heard Mr Crum mention his having received an Order from Genl Hutchinson to have a chest made, for him, according to his direction, by Mr Thrush, sometime after the Enso Mr Crum and Mr Thrush together, the former objected to Mr Thrush that he rejected the Chest would be finished agreeable to engagement — the Defedant returned to the house from which he heard Mr Crum and Mr Thrush in conversation respecting the completion of the Chest — Mr Crum offered that it was neither completed agreeable to
