The Commissioners of Army Accounts upon
the Petition of Doctor Timothy Hemmer
referred to him by the Secretary of War

That it appears from the records & returns
of officers of the [strikethrough: Hosp] Military Hospital
in the Eastern Department that the Petitioner
was appointed a Jun' Surgeon on the 12
d Aug' 1777 and acted as such untill the
4th July 1779 when he was transfer'd as
Surgeon to the 6 Regiment of Connecticut
and in this capacity continued untill [undecipherable]
by [undecipherable] Jan.
That the State of Connecticut in the Settlement
of the account of the Petitioner for Depreciation
on his pay commences his credit from the time
of his entering the regiment without respect or
regard to his services while in the Department
of the general hospital. The denial of payment
for this Service appears to have arose from a strict
adherence to the Laws [undecipherable] of the State which
govern the settlement [undecipherable]
by this act 'twas acquird that the officer should
be in actual service in that department on the
1st January 1780. and the Petitioner having
been transferrd to the Line previous to that date
he was not by literal construction of the Law
an object of its benefits.
But the Commissioners
is of opinion that this was by no means an
equitable [undecipherable] interpretation of the Law and
[undecipherable] appears to
have an undoubted right to a Settlement
of his account for the time he acted as Surgeon to the
hospital and to a Certificate for the balance which
may appear due to him upon such Settlement
