The Commissioner of Army Accounts upon the Petition of the Heirs of the late Lieut. John Harris referred to him by the Secretary at War — respectfully Reports —
That it appears from the musters of the 2nd Connecticut Regiment that Lieut. Harris was in commission on the 8th of January 1777 and was killed in an action with the Enemy on the 7th December in the same year —
That Congress by their resolution dated the 24th August 1780 granted an allowance of half pay for seven years to the Widows or orphan children of officers dying in service of the United States having respect to such as had died previous to the passage of said resolution —
It being a subject of inquiry with the Commissioner whether the State of Connecticut had not granted a compensation on behalf of the United States as recommended by the aforesaid act of Congress he carefully investigated the accounts of the State against the Union and has not found any claim for payment made the Petitioners —
From the consideration of these several facts the Commissioner is of opinion that the orphan children of the late Lieut. John Harris have a right both in law and equity to receive from the United States the amount of a Lieut's half pay for Seven years agreeably to the prayer of their petition —
