Office of Army Accounts New York Jan^y 16. 1790 Sir, On a reference to the Letter of the late Commissi^r of Army Accounts, I find that on the 27 Novem^r 1786, he had in your Account before him a Claim then made by you for a Years Supernumerary pay as a Supernumerary Officer. This Claim has since been presented me by the Hon^bl M^r Goodhue on your behalf & agreeably to his Request I have examined into the Merits of it, the result of this Examination is, that the Years pay had been drawn from the Military Chest at St. Johns, from the then Paymaster and in Settlement of his Accounts with the Auditor for the Eastern Department returned him on the 26 August 1779 — it is not for me to deviate from the established Rules & Customs of the Army, disagreeable for my feelings to inform you that the Rules do not suffer the loss of the depreciation of the Money while in the hands of the Paymasters, consequently the Money left by M^r Haren, subject for your D^r is liable to a liquidation at the time it was returned. Your Claim for Cash advanced, disbursed & expended for Col. Breijer in on their March to Ticonderoga &^c not being supported by Vouchers or any evidence, for what purposes the money advanced cannot be admitted but without a special Act of Congress. Your. Other Claim for sundry Horse Pryges, & Implements of War lost at Ticonderoga is inadmissible, Congress having by their Act of the 14 October 1776 "Resolved that no allowances be made to Officers for any Arms lost or taken from them by the Enemy" — [strikethrough: Your Case if it can peculiarly hard, & perhaps an application to Congress & I regret that it may be proved & the act of that the last attorney for] I am Sir Your Obed^t S^t W^m Howell^t M^r La.
