I have carefully examined the pay Rolls of Colo Tupper's Regt for Part of the Year 1778 & 1779, also the accounts of Major Porter, Paymaster to the Regt for [strikethrough: the] amounts from this examination it appears that of the [strikethrough: Supernumerary] pay allowed to [strikethrough: the] Captain Saml Thoms [strikethrough: Blackburn Mulberry] & Lieut William Stanwood and as Supernumerary Officers, they [strikethrough: have] received three [strikethrough: during the] March 1779 and [strikethrough: it] appears that [strikethrough: Nine] Months pay & [strikethrough: Subsistence] therefore [strikethrough: their accounts] the Months pay is still due each of them: deducting three Months [strikethrough: Subsistence] which by the Act of Congress of the 4 March 1779, was not allowed — their Accounts were

Three Months pay & Subsistence ending the 31 Decr 79. Lieut Abijah Pool of Colo Wigglesworth's Regt does not appear from the pay Rolls in my possession to have received any part of [strikethrough: his pay years pay]. The accounts of Thomas Smart, pay Master to Colo. Wigglesworth's Regt not being settled, [strikethrough: & various] [strikethrough: deficien] I cannot ascertain with precision what part of pay was received by Lt Abijah Pool — those Officers being entitled to Land in pursuance of the Act of Congress of the 16 Septr 1776 [strikethrough: they have been paying] [strikethrough: under various] [strikethrough: I have referred them] to the Secy at War for their proportion accordingly. Warrants for their proportion by applying to the Secy at War.
If the Act of Congress of the 2 Novemr 1785 did not preclude these Officers from a demand on the Union I should not hesitate to give Certificates for such Sums as appear to me on this examination of their Claims to be due; but this Act operating against them will prevent any application to this Office unless Congress may be pleased to [strikethrough: add to] the Contrary & extend the Claims of the Army to a further Period.
