January 10th February 26th May 27th June 14th August 10th
and November 2d [undecipherable] and March 9th 1779 was confined
by the Commander in Chief and Commissions were granted on
the 17th of November 1779 from the War office to those officers that
were then arranging for this arrangement Major Painter was
omitted as appears by the Rolls in the War Office of those Officers that are
continued and therefore he must be considered as a Supernumerary
from that time and entitled to receive a years pay only, by virtue
of the resolve of November 22d 1779.
The appointment in the Artificers if considered as superseding
his military one in Warners Regiment, would grant no reimbursement of more importance than this; for in that case he must
be deemed as deranged by the Act of November 12th 1779 reorganizing
the Artificers and when which he was omitted, as an other Major
arranged to the Regiment.
I must be convinced that the appointment of Major Painter
when it was determined by him not to join his Regiment and
the Commander in Chief has given his sanction to this determination
by directing him to another duty, at rather if that of a Major at large
than as belonging to a particular Regiment which construction would
indeed grant to his widow the seven years half pay she has petitioned
for but the difficulty is that his whole claim must be founded on
his appointment in Warners Regiment, as he was never
displaced from the Regiment or legally received any thing of equal
validity
