[Sep. 26. 1789 Report on Michael Henderson [undecipherable]] The Commissioner of the Army [undecipherable] to whom was referred the Petition of Michael Henderson, beg leave to report. That the Petitioner appears [undecipherable] by a certificate off W^m Donald late enlisted [undecipherable] on [undecipherable] [undecipherable] Regiment, by virtue [undecipherable] served in the British Army in the war against [American?] [undecipherable], [undecipherable] [undecipherable], & now [undecipherable] by [that?] [undecipherable] proclamation dated the [2^d?] of October 1789, [undecipherable] [undecipherable] [undecipherable] the [undecipherable], as [undecipherable] for the said Persons and [undecipherable] of land. That [undecipherable] and by the information contained [in the?] proclamation, [undecipherable] confined, within the bounds of the present United States prior [undecipherable], and not within the [undecipherable] acres aided by any of the State to the Union, [undecipherable] That the Petitioner has not produced [undecipherable] his own attestation that he has not received this donation, [undecipherable] it is not in the power of your Commissioner from any records or papers of the United States to determine who has or who has not received it. [And?] [undecipherable] That there were [undecipherable] that [undecipherable] the Petitioner's [undecipherable] [undecipherable] true evidence, that there must have been a lapse on [undecipherable], [undecipherable] that [undecipherable] whole evidence [undecipherable] it does not appear. That there is at present no provision established by the United States in [boundary?] [undecipherable] [undecipherable] [undecipherable] [undecipherable], [undecipherable] [undecipherable] that the [undecipherable] [undecipherable] [undecipherable] [undecipherable] to the amount [undecipherable]. If the Petitioner ought to [undecipherable] to this amount [undecipherable] [undecipherable] by the [undecipherable], only [undecipherable] [undecipherable] the [undecipherable] [undecipherable] [undecipherable] [undecipherable] [undecipherable] by [undecipherable] expended for this purpose by the British government. Your Commissioner [undecipherable] there has been to report [undecipherable] [undecipherable] [undecipherable] that the Petitioner has no legal title to any [lands?], by virtue of his being an Officer of the United States for the following reasons. 1^st That tho' he has produced a certificate that he served the [3^d?] Regiment of N[orth] Carolina regulars, it cannot be found by any records, musters or returns in the public offices that he ever received an appointment or commission from Congress. 2^d That any provided such an appointment or commission was granted, have the term of his [service?] was not to the end of the war, nor was he discharged by [undecipherable] Congress [undecipherable] unable to the terms and intention of the act of [October?] [undecipherable] granting lands by the United States to the Commission Officers [undecipherable] all which is humbly submitted Your Commissioner [prays?] that [undecipherable] [undecipherable] [undecipherable] [undecipherable] to the Petitioner, it might be found from the equity of the case [undecipherable]
