[Report on [undecipherable] Oct 4. 1786 [undecipherable]] The Commissioner for the Army Accounts to whom was referred the Memorial of William Stewart and Palma Cadey, Beg Leave to Report That independent of the Expectations of the Officers from the Vacancy which may arise on the promotion of th[e] [undecipherable] to the rank a Brigadeer on the Establishment, the Officers have a Claim to promotion by Virtue of Vacancees which have a and Supposed to have arisen in the Course of the Service, and were not filled up. Viz. In the Line of Majors — Made by the Absence or resignation of Major John Taylor who was Continued on furlough from October 1778 to July 1779 and afterwards never mentioned in the Musters. Made by Major Tarlton Woodzen, who was [undecipherable] from August 22. 1777, to October 25. 1780 mustered in furlough in November and December 1780, & omitted afterwards In the Line of Captains — Robert Burns who is mustered no longer than June 1779 James Heron ——————————————— resigned July 1780 Reuben Taylor ——————————————— no longer than to Oct 31. 1781 & Michael Gilbert ——————————————— ditto ——— ditto Matthew McSonnell. transferred to the Invalids [undecipherable] 1781 John Hughes [undecipherable] is mustered — resigned in Dec^m. 1781. Philip Liebert — transferred to the Invalids March 1782 That Supposing that these Officers were legally discharged those remaining, as far as the Musters can determine their Ranks, Claim their promotion agreeably to the annexed list of the New States the most compleat, & as Accurate as can be made out from the Records of the Public Offices That a Resolution of Congress, of the 22 Nov. 1778 having directed that no promotions or Appointments take place in the Regiment, and the Number of Officers being According to the Establishment, [note] and Calculation there on which are Annexed to this report, [W.N°601] out of proportion to the Number by Men were [undecipherable] as your Commissioner presumes, that no promotions took place in those Vacancies, and that the [undecipherable] of the Regiment about the 1 January. 1782 reduced the [undecipherable] Companys which had been Commanded by the Captains whose places were then Vacant, and drafted the Men into the other Companies of [undecipherable] Regiments. That your Commissioner finds, by the Musters that Several Officers of Col. [undecipherable] Livingstone's Regiment — were promoted to Vacancies about the time that Regiment was discharged & the Officers were deranged. That in what Instance, & by what Rules Congress may [undecipherable] to allow & continue stopping, Salary & Compensation to [undecipherable] held Claims of Rank by Virtue of Vacancies which happened while the Army existed is out of the Power of your Commissioner to determine as there is no precedent of this Nature, known to your Commissioner except the one of Col^o.
