I the Commissioner for settling the accounts of the Army, to whom was referred the petition of John Lesuer, Esq., Have to report, that That Ebenezer Stone the Paymaster to the regiment in which, petitioner belonged, drew from the [in 1788 & 1789] military chest, the sum of two hundred Dolls, which on the ballances [due] to Lesuer [strikethrough: that the] First, the said sum or [undecipherable] in [undecipherable] Statement of his account, as paymaster with [undecipherable] was kept [undecipherable] and in August 1789, and returned into the military chest the sum of one hundred & twenty six Dols 85/90 as the ballances then due to Lesuer. That M^r Blois [undecipherable], granted to M^cStone's credit the remainder of the [undecipherable] sum of 248 Dols on paid to Lesuer, the [undecipherable] accountant [undecipherable] found that M^r Lesuer had received it. That the above-mentioned sum of 128 85/90 Dols was [undecipherable] drawn from the Pay Office on the 3^rd day of July 1786, by the the M^r Blore, and advanced by him to other persons for their pay, when money was so much depreciated as to answer in the settlement made with them by your Commissioner to no more value, than 60 for one. That a resolution of Congress of the 28^th day of May 1788, has directed that the pay [undecipherable] beyond the above by the Officers of the regiment, who were to receive their pay in his hands. Whereupon your Commissioner has leave to remark, That the United States cannot be answerable for the repayments of the Depreciation of ballances carried to M^r Stone's credit by M^r B. Blone, who being a public Officer [undecipherable] a disalented person could not do it, without a proper voucher at the time which is most probably mislaid. That the United States also can not be answerable for the depreciation of the money in M^r Stone's hands, as he was the person who legally had an authority to receive it and whose receipt was the sums to the publics as if M^r Lesuer had received it himself. It appears to the Commissioner that the United States are only liable to pay to M^r Lesuer the sum of 128 85/90 Dols 60 for one, being the [undecipherable] the excessive coin [undecipherable] was received from M^r Stone — but on a [undecipherable] supposition that this be inconsiderable [undecipherable] your Commissioner.
