Your Commissioners on a Consideration of the Contradictory evidence given by the same persons, is of Opinion that the Arrangement on which states his resignation to be on the first of January 1781 ought to be Considered as binding because the Certificate of Col^o Elbert ascertains only that he did not resign in 1778 but says nothing as to his Resignation in 1781 and the other Evidences go only to a belief of his Continuance in Service. Your Commissioners is further of Opinion that the proof on which this resignation was grounded which must have been Affirmative ought to appear, that a proper Judgement may be formed of its Validity before the same can be set a side.
