Sir,
Your letter of to day is received. — As the resolution of Congress of the 2d Day of April 1783, which authorizes the payment of your Regiment, has restricted the same to certain conditions, one of which is, "that provided the State shall first fill up their Quota of Troops for the Continental Army" and as it appears by the records of the War Office that the State was deficient in its quota of Troops in the Continental establishment, at the commencement of 1781 in 696 Men, at the commencement of 1782 in 515 Men, and of 1783 in 446 Men, I am under the necessity to suppose that this condition has not been complied with. And as Congress have thought proper to make this a condition, I do not think myself authorized to depart from it without their approbation —
