Canadian] [See { General Index Military Cards] The Commissioner of the Army Accounts to whom was referred the Petition of Andrew Pepen, begs leave to report, That the s^d Pepen held a regular military Commission in Col^t James Livingston's Regiment— That he was returned with the Lieut. Colonel and four Other Officers on the 23^d of June 1779 in the musters of that Regiment as a Supernumerary and furloughed under that Issue for twelve months, which furlough appears to have taken place That he was never afterwards continued in the Musters & Returns of the Regiment or was he reported as one of the Officers deranged when the Regiment was dissolved — That he received a pass in the year 1780 from one of the aids of the Commander in Chief— as a late Lieutenant of Livingston's Regiment— Your Commissioner is therefore of Opinion that M^r Pepen became a Supernumerary Officer in June 1779 under the premises of Congress of November 24^th 1778 which entitled him to one years pay and that [undecipherable] being out of service he cannot claim the benefit of any subsequent grant made to staying Officers. The certificates which M^r Pepen produces of the sacrifices made by him by joining the Army in Canada, of his faithfull services as an Officer, and the acting as a volunteer in other Corps, cannot as your Commissioner believes, confer on him any title to allow any thing beyond that which he has already received, and such as are granted to the late Canadian Refugees and the volunteers of the Army
