I am of opinion that Capt.n Eliot is entitled to have his Account settled for past Services according to the Contract he made with the late Secretary of War & that it will not be proper for you or me to enquire whether that Contract was a proper one with respect to the time in which Capt.n Eliot has been acting under it. With respect to his Account for proving Cannon I do not think he can be entitled to the extra Compensation contended. For as above, as superintending the Works at Philadelphia & other extra compensation as an officer detached on the extra service of proving Cannon at the same time
